If you are injured through the fault or negligence of a third party, be it while traveling in a car, while at work, or other means, you have three years under North Carolina Law to file a personal injury case. When determining the amount of damages to award, an injured person’s pain and suffering is calculated by multiplying the medical bills by a number that is determined by the seriousness of the injury or injuries. Documentation is provided to show the injuries and treatment involved, and an impact statement is given to the court and jury to show any quality of life changes due to an injury or injuries.
A personal injury case involves a legal dispute when an individual suffers injury due to the negligence of another party. This may include car accidents, slip and fall cases, medical malpractice, product liability, and many others. In these cases, you may be seeking compensation for damages, such as medical expenses, lost wages, pain and suffering, and other related costs.
If you have been harmed due to someone else's negligence, a personal injury attorney can help guide you through the legal process while protecting your rights and building a strong case. An experienced personal injury attorney can provide valuable guidance, investigate the incident, gather evidence, assess the damages, negotiate with insurance companies, and represent your interests in court if needed. By having a skilled attorney by your side, you increase your chances of obtaining fair compensation for your injuries and losses.
Choosing the right personal injury law firm is crucial to the success of your case. When selecting a law firm, consider the experience and expertise of the firm, client reviews, personalized attention, and communication.
A workers' compensation attorney specializes in helping employees who have been injured or become ill due to work-related incidents.
These attorneys are well-versed in workers' compensation laws and can guide you through the complex process of filing a claim, ensuring that you receive the benefits you are entitled to. It is advisable to hire a workers' compensation attorney if your claim has been denied, your benefits have been terminated prematurely, your employer disputes your claim, or if you believe you are not receiving fair compensation for your injuries or lost wages. An attorney can advocate for your rights, gather evidence, negotiate with insurance companies, and represent your interests in any legal proceedings.
A criminal offense refers to any act that violates the law and is punishable by the government including minor infractions to serious felonies.
If you have been arrested or charged with a crime, it is important to seek legal representation early on as that can significantly impact the outcome of your case.
Some criminal offenses include violent crimes such as murder, assault, robbery, or rape, property crimes, drug offenses, cybercrimes, sex offenses, business-related crimes, and more.
Under North Carolina Public Safety Law, there are five levels of driving while impaired that are considered misdemeanors: Level I to Level V. Level I is the most serious misdemeanor charge, and Level V is the least. The possible sentences under the law range from a fine of up to $200 and a minimum jail sentence of 24 hours and a maximum of 60 days for Level V offenses to up to a $4000 fine and minimum and maximum sentences of 30 days and two years, respectively. In the case of a Level I offense, a judge cannot suspend the minimum sentence. Those considered to be Level I and II offenders are repeat offenders, persons whose license is revoked, impaired drivers, impaired drivers who are transporting young children, and impaired drivers who hurt someone in a crash.
If a person has three driving while impaired convictions within a seven-year period, the third will be considered a felony offense and includes a minimum jail sentence of one year that cannot be suspended by a judge.
